Administrative Order of the Chief Administrative Judge. Public Access to Certain Filings.

On February 19, 2014, Chief Administrative Judge A. Gail Prudenti, signed the order Section 207.64 of the Uniform Civil Rules of the Surrogate's Court limiting public access (including title companies) to certain types of Surrogate's Court documents, including death certificates and documents containing social security numbers.  

This new section of the law prohibits the public from viewing files for proceedings related to Section 17 and 17-A of the Surrogate's Court Procedure Act, which concerns guardians, custodians, and the guardianship of developmentally disabled personals.  

Sometimes title companies need access to these documents in order to ascertain who has authority to sell real property and what this means is that title companies are going to be forced to rely upon attorneys to provide copies of these documents which attorneys may have grown accustomed to getting from the title companies.
